By accessing and using InsuranceComplaintCheck (the "Service"), operated by OpenDataHQ, you agree to be bound by these Terms of Service. If you do not agree, you must not access or use the Service.
2. Service Description
InsuranceComplaintCheck provides AI-enhanced analysis of insurance complaint data sourced from the NAIC and state Department of Insurance databases. The Service is provided for informational and educational purposes only.
3. Not Insurance or Legal Advice
InsuranceComplaintCheck does NOT provide insurance, legal, financial, or professional advice of any kind. All AI-generated analyses, risk scores, and consumer tips are algorithmic outputs based on public data. Always consult licensed professionals before making insurance or legal decisions.
4. Data Accuracy and Limitations
We cannot guarantee the completeness, accuracy, or reliability of complaint data or AI analyses. Complaint data represents the consumer's perspective. AI analyses are probabilistic and may contain errors. Past complaint patterns do not predict future performance.
5. User Conduct
You agree not to use automated scraping without permission, harass or defame individuals, misrepresent content as official government information, disrupt the Service, commercially exploit content, or violate applicable laws.
6. Intellectual Property
The InsuranceComplaintCheck platform, design, AI analyses, and data compilations are proprietary to OpenDataHQ. The underlying complaint data originates from public NAIC and state DOI databases.
7. Advertising
The Service displays third-party advertisements through Google AdSense. We are not responsible for third-party advertisement content. Your interactions with advertisers are solely between you and the advertiser.
8. Third-Party Links
The Service may contain links to third-party websites including the NAIC and state DOI websites. We do not control and are not responsible for third-party content or practices.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENDATAHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless OpenDataHQ from claims arising from your use of the Service, violation of these Terms, or violation of third-party rights.

We may modify, suspend, or discontinue the Service at any time without notice. We may update data sources, AI models, and methodologies without prior notice.

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles.
